Carl Barry Files Suit for Austin Pedicab Driver

You might remember the strange story back in late October of a young woman throwing a bowl of ice cream at a pedicab driver and his passengers and then ramming into them with her SUV. Attorneys Carl R. Barry and Brett A. Burlison of the Barry Law Group have officially filed suit on behalf of that pedicab driver and the passengers that were riding with him at the time of the incident.

Austin DWI accident attorneyThe petition details how the defendant, 19-year-old Elle O’Brien, allegedly threw a bowl of ice cream and hurled obscenities at the passengers, then proceeded to rear-end the pedicab with her SUV. The young woman reportedly fled the scene but was later arrested that night on suspicion of DWI and assault with a deadly weapon.

The defendant faces a lawsuit with the following allegations:

  • Negligence for operating the vehicle in an improper and unsafe manner
  • Failure to maintain proper control of the vehicle
  • Gross negligence for operating the vehicle under the influence of drugs and alcohol
  • Failure to remain at the scene of the collision

Carl Barry commented on the case, saying, “We want to send a message that drinking and driving will not be tolerated in Travis County. What we allege the defendant did is inexcusable, and my clients deserve compensation for their injuries.”
