Carl Barry's DWI CaseTwo downtown bars along with a drunk driver have been implicated in a lawsuit filed by Carl R. Barry, the lead attorney at the Barry Law Group. The lawsuit involves a 13 year-old girl who was struck and nearly killed by the drunk driver, whose name has yet to be released.

The case claims that the two popular bars (Barcelona Bar and Toulouse Bar) continued to serve alcohol to the driver until she was obviously beyond the point of intoxication (over three times the legal limit, to be exact), and then allowed her to get into her vehicle and drive away. The drunk driver soon lost control of the car and struck a 13 year-old girl while she was walking on the sidewalk. The lawsuit also reveals that the driver initially abandoned the young girl at the scene of the crash.

The young victim is even now receiving around-the-clock intensive care and requires a permanent feeding tube. The girl’s family has turned to Carl Barry for the legal help needed to fight the unjust act committed against their daughter.

“This is a travesty,” Barry said. “My client, a bright, ambitious and well-liked girl, had her entire life ahead of her. Now she requires around-the-clock care and will have to be fed through a feeding tube for the rest of her life. This was an avoidable tragedy. Had these two downtown bars chose the public’s safety over profit, this never would have happened. My client’s life will no doubt never be the same and neither will the lives of the people who love her.

“It is the absolute duty of all downtown bars that primarily make their money through the sale of alcohol to ensure that they are not over-serving their patrons and then allowing them to drive drunk. This driver was at least three times over the legal limit at the time of the accident and her intoxication was undoubtedly visible, evident and easily observable, yet they still kept serving her alcohol and then let her drive. It is our hope in this case that justice prevails.”
